In 2009, Erin had her privacy violated, when photos and a video were published where she appears naked in a hotel room. The images were taken through a kind of peephole, without Erin’s permission. “Dad, I’m naked all over the Internet,” she frantically screamed during a phone call with her father and said it was an “”an out of body experience.” 

Michael David Barrett, the man who filmed the nakedness of the American reporter ESPN was arrested at the Chicago airport and appeared in federal court. According to FBI officials, he is accused of having “spied on” Erin to obtain the images. He then allegedly tried to sell the videos to the TMZ website and to have the images published on the internet, but an employee of the site reported the case to Andrews’ lawyers, which started the investigation.

FBI agents explained that 7 of 8 videos posted on the web were filmed with a cell phone camera, through a modified peephole, while Erin was alone and naked in hotel rooms in Nashville, Tennessee, in September 2008. According to investigators’ reports, she was unable to identify the eighth video.

The accused named Barrett knew where she was staying and got a room next to hers. When she found out he had done this multiple times, she said: “Nobody ever called me,” she said. “Nobody ever told me when I checked in that he asked to be put next to me.” 

Later in her testimony, Andrews added: “I am so angry. This could have been stopped.”

According to the reporter’s lawyers, she suffered psychologically from the case, was threatened and also feared that “even more intimate” images would become public.

In March 2010, Barrett was sentenced by the Los Angeles federal judge and ordered to pay Andrews $7,366 in restitution.
